By Sam Bushman
My fellow Americans, I was happy to have you along today with Lowell Nelson of CampaignForLiberty.org riding shotgun with me. We came out of the gate swinging because there is so much to talk about and so little time it feels like. We talked judges, the supreme law of the land, John and Nisha Whitehead, Andrew Napolitano, Murray Sabrin, and then I gave a big old shame to the Donald over what he said about Nicki Minaj.
Judges are out of control
The question became, what about these judges? Are these judges out of control? Yes, they are. They're out of control, ladies and gentlemen. Most people don't even think about judges. Once in a while they're on the ballot, and all you have to do is retain the judge, yes or no, and people don't really know anything about the judges they're retaining.
Lowell remembered Judge Leslie Lewis, who lost her retention election after a brother of a man on trial for poaching a deer stood up, exhaled, and left the courtroom. Judge Lewis treated that like a tremendous act of disrespect, had the bailiff pursue him, hauled him back in handcuffs, publicly excoriated him, and held him in a cell for roughly 20 minutes. It was caught on video, it circulated, and 54 percent of voters said no. Lowell said she was really the second district judge in modern Utah history ever to lose a retention election.
Then we talked about Utah Supreme Court Justice Jill Pullman, P-O-H-L. Lowell said Utah's pro-life law took effect when Roe v. Wade was overturned, but only for three days. Roe was overturned on Friday; Utah's trigger law went into effect, and on Monday Planned Parenthood filed an injunction, and the court granted it. The Utah Supreme Court, which included Judge Pullman, agreed with Planned Parenthood, and babies have continued to die since then. She is the only Utah Supreme Court justice on the ballot this year.
My take is simple. If you're in Utah, vote no on Judge Jill Pullman. Eagle Forum gets credit for bringing that to our attention. More broadly, we need to publish records of judges: what they voted for and against, their stint on the court, their background, what they stand for, what they do. My standard mode of operandus has been: whenever there's a chance to vote a judge out, just vote them out, unless I can get real details. The longer they're there, the worse they seem to get. Vote as if the Constitution depended on it.
Question those in power
Lowell brought up John and Nisha Whitehead's column at RonPaulInstitute.org, and I think their comment on this is perfect. They wrote that somewhere along the way Americans seem to have forgotten that independent thought is not an act of political betrayal. Neither is holding government officials accountable to the Constitution.
The most important question is often the last one we think to ask: Is what the government is actually doing constitutional? It shouldn't matter whether the public servant is Republican or Democrat, male or female, or whether you like them or not. What matters is whether the government action is constitutional.
The quote that really got me was this: "After all, the real betrayal of America is not questioning those in power, it is surrendering our principles to keep them there." That to me is one of the most poignant quotes I have read in a long time. Party aside, sir.
I reminded folks that when we had the Declaration of Independence, there were no parties involved. There was the American side and there was the English side. You either wanted to be under King George or you wanted to be free. That's how we need to look at it today. If it backs the principles of the supreme law of America, we're for it. If it doesn't, we're against it. Parties aside.
Our failed adherence, not a failed Constitution
Andrew Napolitano wrote a great column titled "Our Failed Constitution." I love what he writes 99 percent of the time, but I wanted to change that title. The Constitution isn't failed. It's our failed adherence to the Constitution. It's the people. It's our willingness to demand and insist on application, pure application, of the Constitution that's the problem.
Napolitano's key line was right: "The Constitution cannot save a people who have abandoned the principles from which it sprang." The principles work. They come from the Bible. They come from God Almighty. They can chain down those who would destroy liberty. But we must apply it.
Murray Sabrin and the Abolition Manifesto
Murray dedicated his work to the memory of his parents and the millions who suffered under totalitarian governments, and to Americans who deserve to live where individual liberty, personal responsibility, sound money, peace, voluntary cooperation, and constitutional government are living principles. He wants to inspire the peaceful abolition of the welfare-warfare state and the restoration of a free America.
That's where I stand with him. We need to eliminate unconstitutional federal spending, get rid of the monetary monopoly of the Federal Reserve, get rid of income and payroll taxes, dismantle the machinery of government welfare and corporate subsidies, and return American foreign policy to a non-interventionist foundation. I don't want to dissolve the government or jettison states from the union. I want to abolish those things government has no authority over in the first place.
Shame on President Trump
Before the end of the hour, I had to mention Donald Trump at a rally with Nicki Minaj. She said, " Go Trump, we love Trump, and all that. But during his remarks, Trump praised Nicki Minaj's backside and called it one heck of a beautiful A, and asked her to stand up.
As president, married man or not, you don't do that as president of the free world. You don't do that as a married man. Shame on you, Donald Trump. Absolutely shame on you. It degrades women and focuses on them as sex symbols. Lowell said he was focusing on the wrong thing, and he was right.
