Oregon State Sen. Brian Boquist (R-Dallas) had a stepson who was a Navy Veteran who committed suicide with a gun. In reaction, the Republican has proposed a new law that would allow the state to confiscate any guns in the possession of a person “showing signs of wanting to commit suicide.” As Breitbart pointed out, “It is important to note that Boquist’s bill allows for ex parte hearings for gun confiscation. In such cases, the petitioner would ask for a confiscation order and that order could be issued without the gun owner being present,” or being notified.
While it may seem reasonable to not let someone “at risk” of suicide have access to a gun, psychology is not a true science and false mental evaluations are easy to obtain by vindictive family members or tyrannical governments, and should not be allowed without the person being allowed to confront his accusers and be represented by counsel.
